Terms of Service – Real Agent Connect

Real Agent Connect is a part of Jusi Creative Inc. These are the Jusi Creative Inc. terms of service. The rules are designed for the benefit of all users. In case of uncertainty, all members are provided these simple guidelines to help with successful operation of Jusi Creative Inc. for all.

By using any Jusi Creative Inc. website (“Service”) you are agreeing to be bound by the following terms and conditions (“Terms of Service”).

Jusi Creative Inc. reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time here.

You understand and agree that Jusi Creative Inc. cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.

When you fill out any form on any Jusi Creative Inc. website including RealAgentConnect.com or any of it’s subdomains you confirm and understand that:

You are 18 years old or older.

You are a human. Forms filled out by “bots” or other automated methods are not permitted.

You are responsible for all Content posted and activity that occurs as a result.

You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You own the copyright to any images you send to or attach to any form or email to Jusi Creative Inc. and agree to Jusi Creative Inc. using such images on, but not limited to Jusi Creative Inc.’s website and social media network as well as any of your own social media platforms that you have given us access to.

You will not hold Jusi Creative Inc. responsible for any harm that may come to yourself as a result of using Jusi Creative Inc.’s services.

Jusi Creative Inc. may share any information you provide about yourself or the products you are marketing on platforms including, but not limited to their social media network and any of your own platforms that you have given Jusi Creative Inc. access to.

Jusi Creative Inc. services greatly enhance your chances of selling your products and services, but that there is no guarantee that your products or services will sell or that Jusi Creative Inc. can help in this in any way shape or form. You are liable to pay for all services ordered on www.Jusi.ca or any of it’s subdomains as well as on Real Agent Connect.ca or any of it’s subdomains by the due date on any invoice sent to you. You also must pay for any services you approve over email with any Jusi Creative Inc. representative.

There will be no refund for any paid advertising ordered through Jusi Creative Inc. regardless of whether you sell the product or services we are promoting for you or not. All services ordered must be paid in full by the due date on any invoice sent to you by Jusi Creative Inc. Or Real Agent Connect.

That after seeing your information in ads we create for you anyone may contact you about the product or service you are promoting or otherwise with the contact information you provided to us and that we have used in the creation of advertising campaigns for you. You understand that Jusi Creative Inc. has no control over this and that you will not hold Jusi Creative Inc. or any of it’s representatives responsible for any unwanted happenings that come as a result of this.

Control of any information you provide Jusi Creative Inc. is solely your responsibility and you can choose not to provide this information should you so desire.

ADVERTISING:

By filling out any form on www.Jusi.ca or any of it’s subdomains and/or Real Agent Connect and/or any of it’s subdomains, you are giving Jusi Creative Inc. the right to create advertisements for you with the information provided on the form or information that is accessible through any link you include on the form on Facebook, Instagram, and other social media platforms. You also give Jusi Creative Inc. the right to link those advertisements to any link you include on the order form or that exists on your website. You hereby give Jusi Creative Inc. the right to promote your products and services on all social media networks (including but not limited to Facebook and Instagram) on your behalf. You also give Jusi Creative Inc. the right to post information about your products and services on but not limited to it’s own website and social media network including but not limited to Facebook, Twitter, & Instagram.

You hereby acknowledge and agree that you are solely responsible for all materials that you provide for publishing, display, and distribution by us in connection with the Services, or that you post, publish or distribute in connection with the Services, including without limitation, advertisements prepared by us for you (including all information, trademarks, and photographs contained in such advertisements), information, data, text, software, links, photographs, pictures, graphics, video, messages, files and any other materials (“User Content”). You represent, warrant and agree that no User Content that you provide for publishing, display, and distribution by us, or submitted by you or through Jusi Creative Inc. (namely www.jusi.ca and any of it’s subdomains and/or Real Agent Connect.ca and any of it’s subdomains), will:

violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights;

contain libelous or defamatory material; or

violate or encourage violation of any applicable laws, regulations, rules, professional codes, codes of ethics, administrative laws, codes of conduct or standards (including, without limitation, rules, standards or codes of conduct for non-governmental or quasi-governmental associations), e.g., federal, state, provincial, or local laws, regulations, rules, professional codes, codes of ethics, administrative laws, standards or codes of conduct applicable to you, data protection, privacy and email communications (collectively, “Applicable Laws”).

For the purpose of clarity, by using us to publish and distribute an advertisement about your products and services or yourself prepared by us for you, you are approving the publishing of such advertisement by us on your behalf. You represent and warrant that you have all legal rights necessary to publish and distribute (or necessary to have us publish and distribute) any User Content or that you own such User Content. You represent and warrant that the advertisement prepared by us for you will comply with all applicable laws, rules, and regulations. You hereby acknowledge and agree that we shall, at all times, possess the right to refuse to include and/or to cause the removal of any or all of your User Content for any reason and at our sole discretion. You hereby acknowledge and agree that we may, at our sole discretion, disclose your User Content in order to: (i) comply with law enforcement, court orders, or the legal process; (ii) protect the rights and safety of individuals; and/or (iii) settle disputes over intellectual property ownership.

MODIFICATIONS TO THE SERVICE & PRICES:

Jusi Creative Inc. reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Prices of all Services are subject to change at any time.

All prices are posted in Canadian dollars and all invoices are to be paid in Canadian dollars unless otherwise discussed.

Jusi Creative Inc. shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

All content posted on the Service is must comply with Canadian & American copyright law.

We claim no intellectual property rights over the material you provide to the Service for the purpose of creating advertisements for you. Your materials uploaded or included on any form available from Jusi Creative Inc. remain yours.

Jusi Creative Inc. does not pre-screen Content, but Jusi Creative Inc. and it representatives have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service.

The look and feel of Jusi Creative Inc. (namely www.Jusi.ca & any subdomains of www.Jusi.ca and/or www.RealAgentConnect.com & any subdomains of Real Agent Connect.ca) may not be copied. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML/CSS or visual design elements without express written permission from Jusi Creative Inc. You may also not copy or re-create any of the systems we use in the promotion of any of your listings without express written consent from Jusi Creative Inc. This also includes any websites or funnels that Jusi Creative Inc. creates for the purposes of advertising your business. We retain full ownership over any website or funnel that we build for you and any attempting at recreating or copying our processes and systems is strictly prohibitied.

GENERAL CONDITIONS:

Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.

Technical support is available but not guaranteed to solve any issues or problems you may have.

You understand that Jusi Creative Inc. uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run any Service Jusi Creative Inc provides to you.

You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Jusi Creative Inc., or any other Jusi Creative Inc. service.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Jusi Creative Inc.

We may, but have no obligation to, remove Content containing Content that we determine in our sole discretion as unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Jusi Creative Inc. customer, employee, member, or officer will not be tolerated and will be dealt with to the full extent of the law.

You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

You must not upload, post, host, or transmit unsolicited email, SMSs, or “spam” messages.

You must not transmit any worms or viruses or any code of a destructive nature.

Jusi Creative Inc. does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.

You expressly understand and agree that Jusi Creative Inc. shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Jusi Creative Inc. has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.

The failure of Jusi Creative Inc. to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Jusi Creative Inc. and govern your use of the Service, superseding any prior agreements between you and Jusi Creative Inc.(including, but not limited to, any prior versions of the Terms of Service).

ADVERTISING BUDGETS:

Any advertising budgets entered or approved by you on any form on www.Jusi.ca or any of it’s subdomains and/or www.RealAgentConnect.com or any of it’s subdomains and/or over email with a Jusi Creative Inc. representative gives Jusi Creative Inc. the right to spend this budget whether a daily or a lifetime budget with Facebook Ads or Google Ads or any other pre-discussed advertising platform to promote the ad campaign, funnel, website, or other in question on the form or your business as a whole. Jusi Creative Inc. or any of it’s representatives will not be held responsible for any accidental advertising budget entries on any form found on www.RealAgentConnect.com or any of it’s subdomains and/or www.Jusi.ca or any of it’s subdomains. Additonally we will not be held responsible for spending any ad budget erroneously sent or approved via email with any Jusi Creative Inc. representative.

You understand that payment of any advertising budgets entered on any form on www.Jusi.ca or any of it’s subdomains and/or www.RealAgentConnect.com or any of it’s subdomains and/or discussed over email with a Jusi Creative Inc. representative are payable to Facebook Ads and Google Ads or any pre-discussed advertising platform and are solely the responsibility of you (the customer) to pay and not that of Jusi Creative Inc. or any of it’s employees or representatives.

For the purposes of clarity, it should be noted that advertising budgets entered on www.Jusi.ca or any of it’s subdomains and/or www.RealAgentConnect.com or any of it’s subdomains and/or ad budgets discussed over email with a Jusi Creative Inc. representative will be in the currency of the country your business is located. For example, if you are a real estate agent in Boise, Idaho then advertising budgets you enter in Private Office will be considered to be in USD or American Dollars. If you are a real estate agent in Edmonton, AB then advertising budgets you enter into Private Office will be considered to be in CAD or Canadian Dollars.

PAYMENT OF INVOICES SENT TO YOU BY JUSI CREATIVE INC.:

You understand that any products or services ordered through Jusi Creative Inc. will be added to your monthly invoice sent to you from Jusi Creative Inc. You agree to pay all costs on any invoice sent to you no later than the due date on the invoice.

You understand that failure to pay any invoice sent to you by Jusi Creative Inc. by the due date on the invoice can result in the suspension or termination of any and all of your services with Jusi Creative Inc., a complaint being filed (for example with your real estate brokerage, your real estate board, or your dealership group) and legal action being taken against you.

All invoices must be paid by the due date on the invoice sent or will be subject to a 5% per month interest charge of the total amount payable on the invoice.

STATISTICAL REPORTS:

Any statistical report sent or provided to you by Jusi Creative Inc. while deemed to be accurate cannot be guaranteed. Even though Jusi Creative Inc. will not be held responsible for any differences in data between Google Analytics and any statistical report Jusi Creative Inc. sends to you, we suggest checking your stat report against Google Analytics data if you are confused or concerned about the accuracy of any statistical report that Jusi Creative Inc. sends to you.

Any statistical report sent to you by Jusi Creative Inc. that you share with a client or clients or any other person is done solely at your discretion. You are fully responsible for any data in the statistical report provided to you and how it may be interpreted by your client(s) or anyone else you happen to share it with. Jusi Creative Inc. will not answer any questions about any of your listings, products, or statistical reports sent to us by your client(s) or any other person(s) other than yourself.

CREATION OF ACCOUNTS ON YOUR BEHALF

You may from time to time hire Jusi Creative Inc. to create an account on your behalf on platforms like, but not limited to Facebook, Facebook Ads, Google Ads, Instagram, and more. Jusi Creative Inc. may also from time to time create accounts on platforms on your behalf. When hiring or otherwise having Jusi Creative Inc. create an account on any platform on your behalf you certify that you are allowing Jusi Creative Inc. and any of their employees and/or representatives to agree to all terms and conditions and the privacy policies of any of said platforms that you have hired Jusi Creative Inc. to create an account on for you. You understand that terms and conditions for any of said platforms are readily available online and that you have already read them before hiring or otherwise having Jusi Creative Inc. create an account on the platform on your behalf. You will not ever hold Jusi Creative Inc. and/or any Jusi Creative Inc. employees and/or representatives responsible for any unwanted circumstances that might arise from the creation of accounts on platforms you have hired or otherwise have had Jusi Creative Inc. create for you on your behalf. You also understand that Jusi Creative Inc. cannot answer questions about any terms and conditions or the privacy policies of of any platform that you hire Jusi Creative Inc. to create an account on on your behalf. Questions about terms of service, privacy policies, and other information related to your account on said platform should be taken up with the platform itself before you ever hire Jusi Creative Inc. to create an account for you on the platform on your behalf.

PIXEL INSTALLATION:

While setting you up to use some of our marketing systems Jusi Creative Inc. or one of our employees or representatives may ask that you install coding and/or pixels from Google Tag Manager on your website. Jusi Creative Inc. may then use Google Tag Manager to install coding and/or pixels on your website from but not limited to Facebook Ads, Google Ads, and Google Analytics. You understand that it is solely your responsibility and not that of Jusi Creative Inc. or any Jusi Creative Inc. employee or representative to make sure that the Privacy Policy and Terms Of Service on your website and any of it’s subdomains are up to date to reflect for your users any code or pixel installed on your website by Jusi Creative Inc. or any Jusi Creative Inc. employee or representative.

You understand that you can ask us at anytime which pixels or coding we have installed on your website for the purpose of updating your Terms of Service and/or Privacy Policy or for any other purpose by contacting Jusi Creative Inc.

You understand that you may never under any circumstances hold Jusi Creative Inc. or any Jusi Creative Inc. employee or representative liable for any unwanted circumstances that may result from the installation of any code or pixel installed on your website by Jusi Creative Inc. or any Jusi Creative Inc. employee or representative.

DATA YOU PROVIDE TO US:

When you provide any data to us through a .csv or or any other type of file or data you are confirming that we have right to advertise to or email to any of the contacts on the .csv file or any other type of file or data on your behalf. You confirm that you legally obtained the data you provide to us and that you are allowed to provide that data to Jusi Creative Inc. for the purposes of advertising your business. You confirm that at no time will you ever hold Jusi Creative Inc. or any of it’s employees or representatives liable for any unwanted circumstances that result from us emailing, advertising to, or otherwise contacting any person whose data you have provided to us for this purpose.

You understand that it is up to you and not Jusi Creative Inc. or any of Jusi Creative Inc.’s employees or representatives to confirm that you are allowed to have Jusi Creative Inc. advertising to or otherwise contacting (through email for example) any person whose data you provide to Jusi Creative Inc. Please check all applicable email marketing or other advertising laws and standards that may apply to you before you hand any contact data over to Jusi Creative Inc. for the purposes of advertising to or contacting via email on your behalf.

LEAD GENERATION DATA:

When you hire us to generate leads for you from time to time, we may need to share lead information with third-party service providers and sub-processors that provide services on our behalf when someone uses a website or lead generation system that we designed for you. They may have access to your lead’s personal data only to perform their tasks on our behalf, and are obligated not to disclose or use it for any other purpose. While we do not disclose the full list of these service providers online, the sub-processors fall into the following categories:

Server hosting providers;

Customer support software;

Application analytics software;

Subscription management software; and

Webpage editing software.

It is 100% your responsibility to make sure that your privacy policy or any privacy policy you provide to us includes this information if you are required to do so by law.

When we create a funnel or website for you we may include links to terms and conditions and / or a privacy policy for that funnel or website. These policies and terms are 100% your responsibility to uphold and you will not hold Jusi Creative Inc. or any of it’s representatives responsible for any situations arising from these policies. Any policy or terms of service we send you or include on a website or funnel is for example purposes only and not constitutive of legal advice. We highly recommend contacting your lawyer before confirming that we are allowed to use any terms of service or privacy policy on any funnel or website that we create for you. We will happily edit in a reasonable timeframe the terms of service or privacy policy page of any funnel or website we create for you to comply with what you need it to say and your own data handling policies. We will also happily answer in a reasonable timeframe any questions you need to ask about the function of the website or the funnel that we create for you as it pertains to the terms of service and / or privacy policy you wish to appear on said funnel or website. You will at no time under any circumstance hold Jusi Creative Inc. responsible for any unwanted circumstances arising from your privacy policy or any privacy policy we have provided to you.

CONTEST CREATION

If we create a contest for you it is 100% your responsibility to pay for the contest and to facilitate choosing a winner. You will at no time hold Jusi Creative Inc. or any of it’s representatives responsible for either paying for or facilitating the choice of a winner for any contest we run for you. We are simply providing the digital technology to run your contest and nothing more. It is 100% your responsibility to deal with all contest inquiries and to abide by the contest rules, regulations, and terms that you approve or lay out.

GRAPHIC DESIGN

If Jusi Creative Inc. creates a customer certificate or any other graphic offering any type of sale, discount, or offer for your business you are 100% responsible for the facilitation of said sale discount or offer. We strongly recommend making sure all fine print on any advertisement or certificate we provide for you is accurate to what you need it to be from a legal perspective. You will not at anytime hold Jusi Creative Inc. or any of it’s representatives responsible for any unwanted circumstances that come from any ad campaign, certificate, offer, sale, or any other creative that we provide for you. Jusi Creative Inc. is simply facilitating the technical and design tools for you to promote your campaign and are not in any way, shape, or form responsible for the facilitation of that offer or promotion from a customer facing perspective.

EXCLUSIVITY:

We do have exclusivity agreements with some companies and individual real estate agents in some areas. If you pay a setup fee and are a company or real estate agent in one of these areas, or if we decide we do not want to work with you for any other reason, your setup will be refunded in full in a timely manner.

CANCELLATION OF YOUR SERVICES FROM JUSI CREATIVE INC. END:

Jusi Creative Inc. reserves the right to either not work with you at all or to cancel any and/or all services with you at anytime.

If Jusi Creative Inc. cancels any service they provide you with, any monthly fees charged for any service will be invoiced or refunded to you at a price pro rated for the amount of days left in the month when Jusi Creative Inc. cancels its service with you. For example, if you are paying $30 per month for one of our products or services that you paid in full for at the start of the month and you cancel with 3 days left in a month with 30 days in it then you would be refunded $3. Facebook Ads and Google Ads budgets are charged directly to you from said platforms and are non refundable. We will shut off all ads currently running on your accounts within one business day of Jusi Creative Inc.’s cancellation of services with you. At that time, advertising budgets will no longer be spent on those platforms. Any outstanding advertising budgets on Facebook Ads and Google Ads accounts we create for you or you have added us to still to be paid would likely be charged to you at the time of cancellation of your accounts, but this would be at the discretion of the terms of those accounts. Once again, those accounts will be cancelled within one business day of your termination of services with Jusi Creative Inc. If you fail to pay your final invoice to Facebook Ads or Google Ads Jusi Creative Inc. reserves the right to pay those fees on your behalf and to add the full amount to an invoice sent to you or your company from Jusi Creative Inc. All ad budgets spent on your behalf on Facebook Ads and / or Google Ads must be paid in full by you. If you cannot accept this, please do not use our services.

Only the remainder on the monthly fee for the month Jusi Creative Inc. cancels it’s services with you will be refunded upon cancellation. All other fees including but not limited to any services or advertising packages ordered through Private Office or any other subdomain of www.RealAgentConnect.com or Real Agent Connect.ca must still be paid in full. Failure to pay any outstanding amount even after Jusi Creative Inc.’s cancellation of services with you can result in a complaint being filed against you and/or legal action being taken against you.

If Jusi Creative Inc. cancels it’s services with you, you are no longer permitted to use any Jusi Creative Inc. branding on but not limited to your website, social media network, and/or print advertising. This includes but is not limited to any animated videos we have created for you (even if you previously paid for them), your custom “Client Presentation Graphic”, or our logos / branding that you may have posted on your website, social media network, or print advertising. Failure to remove any and all Jusi Creative Inc. branding upon cancellation of services by Jusi Creative Inc. from but not limited to your website, social media network, and/or print advertising can result in a complaint being filed against you and/or legal action being taken against you.

CANCELLATION OF SERVICES BY YOU:

You can cancel your services with Jusi Creative Inc. at anytime and you will receive no further charges from Jusi Creative Inc. other than those for any products or services provided that have not yet been paid for. Facebook Ads and Google Ads budgets are charged directly to you from said platforms and are non refundable. We will shut off all ads currently running on your accounts within one business day of your termination of services with Jusi Creative Inc. At that time, advertising budgets will no longer be spent on those platforms. Any outstanding advertising budgets on Facebook Ads and Google Ads accounts we create for you or you have added us to still to be paid would likely be charged to you at the time of cancellation of your accounts, but this would be at the discretion of the terms of those accounts. Once again, those accounts will be cancelled within one business day of your termination of services with Jusi Creative Inc. If you fail to pay your final invoice to Facebook Ads or Google Ads Jusi Creative Inc. reserves the right to pay those fees on your behalf and to add the full amount to an invoice sent to you or your company from Jusi Creative Inc. All ad budgets spent on your behalf on Facebook Ads and / or Google Ads must be paid in full by you. If you cannot accept this, please do not use our services.

Cancellation of services will not be processed until all currently outstanding invoices you have with Jusi Creative Inc. are payed in full.

All other fees including but not limited to any services or advertising packages ordered through Private Office or any other subdomain of www.Jusi.ca or Real Agent Connect.ca must be paid in full before cancellation of your services with Jusi Creative Inc. will be processed.

If you cancel your services with Jusi Creative Inc. you are no longer permitted to use any Jusi Creative Inc. branding on but not limited to your website, social media network, and/or print advertising. This includes but is not limited to any animated videos we have created for you (even if you previously paid for them), your custom “Client Presentation Graphic”, or our logos / branding that you may have posted on your website, social media network, or print advertising. Failure to remove any and all Jusi Creative Inc. branding upon cancellation of services with us from but not limited to your website, social media network, and/or print advertising can result in a complaint being filed against you and/or legal action being taken against you. Any websites or funnels we have created for you may be taken down and could no longer function upon cancellation of services with Jusi Creative Inc.
